The Islamabad High Court (IHC) ordered the government on Tuesday to retrieve fugitive Kashmiri poet Ahmed Farhad by Friday.

Justice Mohsin Akhtar Kayani issued the directive at the hearing on the poet’s plea for recovery.

Farhad, famed for his uncompromising language, was reportedly kidnapped from his home last week. On May 15, his wife petitioned the IHC for his recovery, requesting that the court identify, investigate, and prosecute those responsible for his abduction.

Iman Mazari, a human rights lawyer, represented the poet’s wife in this case.
The IHC judge accepted Attorney General of Pakistan (AGP) Mansoor Usman Awan’s promises related to Farhad’s rescue and restoration.

“We will do whatever it takes. We will rescue and reclaim Farhad,” the AGP stated, addressing the IHC court and accepting responsibility for investigating the situation.

Syed Ali Nasir Rizvi, the Interior Secretary and Inspector General of Police (IGP) of Islamabad, also attended the court.

Justice Kayani Says

  • According to Justice Kayani, the poet’s abduction has caused further problems for the government.
  • “If one of us cannot be recovered, it will be a failure of the state.”
  • The court instructs the defence secretary to assure his appearance at the next hearing.

During the hearing, Justice Kayani directed the AGP to ensure that “no one gets picked up from Islamabad”.

“If a person does not get recovered, it will be a failure of the state,” the court stated.

AGP Awan responded to the statement by requesting more time to facilitate the poet’s recuperation.

The AGP was questioned by the court about whether or not he consulted with the federal government before making the remark.

The petitioner’s attorney, in the meantime, requested that the AGP provide an update on the patient’s recuperation during the previous six days.

“If the agencies don’t have him, Farhad, then he can be traced at least,” she said.

She mentioned that she had dealt with several cases of similar kind. “I appear in such cases every day.”

At this point, Justice Kayani informed the AGP that the issue has caused further problems for the government.

“I am assuring you that all the available resources will be used,” Awan remarked in response to the court.

Later, when a senior officer was not present, the Islamabad Operations SSP was called to the rostrum and informed the court that the police had obtained a written statement from the Ministry of Defense.

The court then inquired as to whether the ministry’s statement fell under Article 161.

“Police are aware of their responsibilities. Justice Kayani stated, “The court would not meddle in the investigations.

The defense secretary was not present at the hearing, but the interior secretary did show up in court.

The petitioner’s attorney stated, “The defense secretary does not appear whenever he is called.”

Judge Kayani declared that everyone must show up when the court summons them, saying that this behavior needs to stop.

“Anyone can attend the court if the prime minister is allowed to do so. “He is greater than everyone else,” the judge said, ordering the defense secretary to make sure he shows up for the upcoming session.

The case hearing was subsequently postponed until Friday by the court.
